The Retained EU Law (Revocation and Reform) Act, which received Royal Assent on 29 June 2023, allows the Government to amend, repeal and replace retained EU law, ensuring that UK law takes precedence. However, the Government has committed to maintaining existing high regulatory standards where appropriate, and any legislation not listed in the Act's revocation schedule will be retained as UK law at the end of December 2023.
Following conversations with HSE, Build UK has confirmed that key industry health and safety legislation, such as the Personal Protective Equipment at Work Regulations, Construction (Design and Management) Regulations (CDM), and Work at Height Regulations, which fall within the scope of the Act, are not listed in the revocation schedule and will therefore continue to apply beyond December 2023. When any legislation covered by the Act is identified for review, the relevant sector will be consulted in accordance with the Government's consultation principles.
